Religión en Libertad es propiedad de la Fundación Nueva Evangelización para el siglo XXI, una fundación formada exclusivamente por seglares católicos, que son padres de familia y tienen distintas sensibilidades espirituales. Aunque tiene carácter laical, jurídicamente está dentro del amparo de la Iglesia católica como fundación pía autónoma privada, y la rendición de las cuentas y su aprobación, así como otras atribuciones, son competencia exclusiva del arzobispo de Madrid. Asimismo se rige por las disposiciones civiles que le sean aplicables.
La Fundación nace en diciembre de 2012 en respuesta a la urgente llamada de Benedicto XVI en pro de la Nueva Evangelización, y para ello tiene entre sus fines “ofrecer a la Iglesia y a sus miembros los métodos, medios y cauces adecuados para llevar a cabo esa Nueva Evangelización en todas sus fases, poniendo especial énfasis en la transmisión del Kerigma o primer anuncio del Evangelio”.
El presidente de la Fundación Nueva Evangelización para el siglo XXI es Álex Rosal, y su vicepresidente, José Alberto Barreda.
