1- هواجس النفس والحركات البشرية؛ كتصرف الأعضاء، وحركات الجسد، فهذا الأمر لا يتعلق به أمر اتباع، ولا نهي.
2- ما لا يتعلق بالعبادات ووضع فيه أمر الجبلَّة؛ كالقيام والقعود ونحوهما، فليس فيه تأسٍّ، ولا به اقتداء، ولكنه يدل على الإباحة عند الجمهور.
3- ما احتمل أن يخرج عن الجبلَّة إلى التشريع بمواظبته عليه، على وجه معروف، وهيئة مخصوصة؛ كالأكل والشرب واللبس والنوم، وخصوصًا إذا وقع فيه الإرشاد إلى بعض هيئات الأكل أو الشرب أو اللباس أو النوم.
4- ما عُلِمَ اختصاصه به صلى الله عليه وسلم كالوصال في الصيام، والزيادة على أربع في الزواج، فهو خاص به لا يشاركه به غيره". الشوكاني، إرشاد الفحول إلى تحقيق الحق من علم الأصول، ج1 ص73، 74.
