Mazhab jumhur ulama Mazhab Maliki, dan Syafi’i berpendapat, melakukan ibadah kurban hukumnya sunnah muakkad (sunnah yang dipentingkan) dan makruh bagi yang mampu berkurban tetapi tidak melaksanakannyaKurban berasal dari bahasa Arab (Al-Qurban) berarti mendekatkan diri, dalam ilmu fikih berarti penyembelihan binatang ternak, (An’am) berupa kambing, lembu, unta dan sejenisnya, disembelih pada hari raya Idul Adha dan hari Tasyriq (11, 12, dan 13 Zulhijjah),dengan niat mendekatkan diri kepada Allah SWT.
Syari’at berkurban dimulai sejak Nabi Ibrahim As. berrmula dengan sebuah mimpi untuk menyembelih anak kesayangannya Ismail As.(QS.37;102) untuk menguji kepatuhan Nabi Ibrahim As kepada Allah SWT dan akhirnya di tebus dengan seekor sembelihan yang besar (QS.37;107). Kemudian Allah SWT memerintahkan kepada Nabi Muhammad SAW. untuk meneruskan syari’at tersebut pada setiap hari raya Idul Adha dan hari hari hari tasyriq
Pensyari’atan tersebut didasari atas firman Allah SWT.Maka dirikanlah shalat karena Tuhanmu dan berkurbanlah (QS.108:2).dan Sabda Nabi Muhammad SAW.Siapa siapa yang telah memiliki kemampuan tetapi ia tidak berkurban,maka janganlah ia menghampiri tempat shalat kami.(Hadis Riwayat Ahmad bin Hanbal dan Ibnu Majah).
Riwayat yang lain mengatakan; tidak ada amalan keturunan Adam yang paling disukai Allah pada Hari Idul Adha selain menyembelih kurban,sesunggguhnya binatang itu akan datang pada hari kiamat dengan tanduk,kuku dan bulunya.Dan sesungguhnya darah kurban lebih dahulu tercurah karena Allah sebelum ia sampai kebumi yang membuat jiwa menjadi senang.(Hadis Riwayat Turmuzi,Ibnu Majah dan Hakim),dan kurban ibadah kurban ini senantiasa dilaksanakan Rasulullah setiap hari Raya Idul Adha.
