LOI N ° 98/036 DU 31 DECEMBRE 1998 PORTANT CODE PÉNALL’ASSEMBLEE NATIONALE DE LA RÉPUBLIQUE DE GUINÉE
Vu les dispositions de la Loi Fondamentale en son article 59 ;
Après en avoir délibéré, adopte ;
LE PRÉSIDENT DE LA RÉPUBLIQUE promulgue la Loi dont la teneur suit :
DISPOSITIONS PRELIMINAIRES
Article 1er : - Les dispositions de la présente Loi constituent le Code pénal.
Article 2 : - Les sanctions pénales applicables se divisent en :
- Peines de police ;
- Peines correctionnelles ;
- Peines criminelles.
L'infraction que les Lois punissent de peines de police est une contravention.
L'infraction que les Lois punissent de peines correctionnelles est un délit.
L'infraction que les Lois punissent de peines afflictives ou infamantes est un crime.
Article 3 : - La tentative d’une infraction consiste en un commencement d’exécution qui
établit le but injuste poursuivi, même si une cause étrangère en empêche la réalisation.
La tentative est toujours punissable en matière de crime.
Elle n’est punissable en matière de délit que si une disposition expresse de la Loi le
prévoit.
Article 4 : - La peine applicable à la tentative est réduite d’un degré pour les crimes.
En matière correctionnelle, le maximum de la peine est abaissé d’un quart.
Article 5 : - Sauf dispositions expresses contraires, nulle infraction ne peut être
sanctionnée de peines non prononcées par la Loi avant qu’elle fut commise.
La Loi n’est applicable que si elle est plus favorable au délinquant.
Article 6 : - En cas de conviction de plusieurs crimes ou délits, la peine la plus forte est
seule prononcée.
