breach of warranty, misrepresentation, or otherwise, including without limitation, damages for loss of
business profits, business interruption, loss of business information, or other pecuniary loss, arising out of
the use of or inability to use the software, or arising out of this agreement, even if Provider or its
representatives has been advised of the possibility of such damages.
Notwithstanding any damages that you might incur for any reason whatsoever (including, without
limitation, all damages referenced herein and all direct or general damages in contract or otherwise), the
entire liability of Provider and any of its suppliers or agents under any provision of this EULA, End User’s exclusive
remedy hereunder shall be limited to $1.00 USD.
The foregoing limitations will apply even if the above stated remedy fails of its essential purpose.
If any of the provisions of this agreement shall be invalid or unenforceable such invalidity,
unenforceability or lack of enforcement shall not invalidate or render unenforceable the entire agreement,
but rather the entire agreement shall be construed as if not containing the particular invalid or
unenforceable provision or provisions, and the rights and obligations of Provider and End User shall be
construed and enforced accordingly.
