عِلْمٌ يُبَيِّنُ اْلحُقُوْقَ وَاْلوَاجِبَآتِ الَّتِي تَتَعَلَّقُ بِأَفْعَآلِ اْلمُكَلَّفِيْنَ
“Ilmu yang menerangkan segala hak dan kewajiban yang berhubungan amalan para mukalaf”.
Sedangkan menurut pengikut Asy Syafi’i mengatakan bahwa fiqih (ilmu fiqih) itu ialah :
العِلْمُ الَّذِي يُبَيِّنُ الأَحْكَامَ الشَّرْعِيَّةَ الَّتِي تَتَعَلَّقُ بِأَفْعَآلِ اْلمُكَلَّفِيْنَ اْلمُسْتَنْبِظَةِ مِنْ اَدِلَّتِهَآ التَّفْصِيْلِيَّةِ
“ilmu yang menerangkan segala hukum agama yang berhubungan dengan pekerjaan para mukallaf, yang dikeluarkan (diistimbatkan) dari dalil-dalil yang jelas (tafshili)”.
Jadi dapat disimpulkan dari difinisi-definisi di atas, fiqih adalah : ilmu yang menjelaskan tentang hukum syar’iyah yang berhubungan dengan segala tindakan manusia, baik berupa ucapan atau perbuatan, yang diambil dari nash-nash yang ada, atau dari mengistinbath dalil-dalil syariat Islam.
