DENGAN RAHMAT TUHAN YANG MAHA ESAPRESIDEN REPUBLIK INDONESIA,
Menimbang:
a. bahwa anak merupakan amanah dan karunia Tuhan Yang Maha Esa yang memiliki harkat dan martabat sebagai manusia seutuhnya;
b. bahwa untuk menjaga harkat dan martabatnya, anak berhak mendapatkan pelindungan khusus, terutama pelindungan hukum dalam sistem peradilan;
c. bahwa Indonesia sebagai Negara Pihak dalam Konvensi Hak-Hak Anak (Convention on the Rights of the Child) yang mengatur prinsip pelindungan hukum terhadap anak mempunyai kewajiban untuk memberikan pelindungan khusus terhadap anak yang berhadapan dengan hukum;
d. bahwa Undang-Undang Nomor 3 Tahun 1997 tentang Pengadilan Anak sudah tidak sesuai lagi dengan perkembangan dan kebutuhan hukum masyarakat karena belum secara komprehensif memberikan pelindungan kepada anak yang berhadapan dengan
hukum sehingga perlu diganti dengan undang-undang baru;
e. bahwa berdasarkan pertimbangan sebagaimana dimaksud dalam huruf a, huruf b, huruf c, dan huruf d, perlu membentuk Undang-Undang tentang Sistem Peradilan Pidana Anak;
Mengingat:
1. Pasal 5 ayat (1), Pasal 20, Pasal 28B ayat (2), Pasal 28G, dan Pasal 28I Undang-Undang Dasar Negara Republik Indonesia Tahun 1945;
2. Undang-Undang Nomor 39 Tahun 1999 tentang Hak Asasi Manusia (Lembaran Negara Republik Indonesia Tahun 1999 Nomor 165, Tambahan Lembaran Negara Republik Indonesia Nomor 3886);
3. Undang-Undang Nomor 23 Tahun 2002 tentang Perlindungan Anak (Lembaran Negara Republik Indonesia Tahun 2002 Nomor 109, Tambahan Lembaran Negara Republik Indonesia Nomor 4235);
4. Undang-Undang Nomor 13 Tahun 2006 tentang Perlindungan Saksi dan Korban (Lembaran Negara Republik Indonesia Tahun 2006 Nomor 64, Tambahan Lembaran Negara Republik Indonesia Nomor 4635);
5. Undang-Undang Nomor 16 Tahun 2011 tentang Bantuan Hukum (Lembaran Negara Republik Indonesia Tahun 2011 Nomor 104, Tambahan Lembaran Negara Republik Indonesia Nomor 5248);
