القانون التنظيمي رقم 113.14 المتعلق بالجماعاتظهير شريف رقم 1.15.85 صادر في 20 من رمضان 1436 (7 يوليو 2015)، بتنفيذ القانون التنظيمي رقم 113.14 المتعلق بالجماعات، جريدة رسمية عدد 6380 بتاريخ 6 شوال 1436 (23 يوليو 2015)، الصفحة 6660 – 6708.
تنص المادة الأولى من القانون التنظيمي رقم 113.14 المتعلق بالجماعات على ما يلي:
” طبقا لأحكام الفصل 146 من الدستور، يحدد هذا القانون التنظيمي:
– شروط تدبير الجماعة لشؤونها بكيفية ديمقراطية؛
– شروط تنفيذ رئيس مجلس الجماعة لمداولات المجلس ومقرراته؛
– شروط تقديم العرائض من قبل المواطنات والمواطنين والجمعيات؛
– الاختصاصات الذاتية لفائدة الجماعة والاختصاصات المشتركة بينها وبين الدولة والاختصاصات المنقولة إليها من هذه الأخيرة؛
– النظام المالي للجماعة ومصدر مواردها المالية؛
– شروط وكيفيات تأسيس الجماعات لمجموعات ترابية؛
– أشكال وكيفيات تنمية التعاون بين الجماعات والآليات الرامية إلى ضمان تكييف تطور التنظيم الترابي في هذا الاتجاه؛
– قواعد الحكامة المتعلقة بحسن تطبيق مبدأ التدبير الحر لشؤون الجماعة، وكذا بمراقبة تدبير البرامج وتقييم الأعمال وإجراءات المحاسبة”.
وقد عرفت المادة الثانية من نفس القانون الجماعة كما يلي:
“تشكل الجماعة أحد مستويات التنظيم الترابي للمملكة، وهي جماعة ترابية خاضعة للقانون العام، تتمتع بالشخصية الاعتبارية والاستقلال الإداري والمالي”.
وتجدر الإشارة إلى أن المادة 280 من هذا القانون نسخت أحكام القانون رقم 78.00 المتعلق بالميثاق الجماعي الصادر بتنفيذه الظهير الشريف رقم 1.02.297 بتاريخ 25 رجب 1423 (3 أكتوبر 2002) كما تم تغييره وتتميمه.
