Kitab Undang Undang Hukum Pidana berlaku sebagai dasar hukum di Indonesia. KUHP merupakan bagian hukum politik yang berlaku di Indonesia, dan terbagi menjadi dua bagian: hukum pidana materiil dan hukum pidana formil.Semua hal yang berkaitan dengan hukum pidana materiil adalah tentang tindak pidana, pelaku tindak pidana dan pidana (sanksi).
